a page from Heather’s Acoustic Labs printed literature brochure
printed in 2010 and relevant to Heather’s Acoustic Labs published
Tower Crossover Schematic shown on page 25
in this Exhibit C. disclosing most all of the opposing patent’s claim 1
and further detailed in this Exhibit
C.. The brochure was dispersed to those in the industry including to
Dolby at the 2010 CEDIA Expo tradeshow and, with other technical
drawings as Heather had presented her invention to DOLBY in hopes they
would license it from her to license to speaker manufacturers like they
did with their technology to receiver manufacturers. Shown below, in the “Activate Multi-Channel Processing” section which is relevant to the opposing claim 1, the Acoustic Labs 5W-T Pedistool Towers which are illustrated at the left and right of the TV in the front of the listening area are Illustrated with red arrows dispersing sound upward from the top-mounted 2 ½” swivel “drivers”. The visual representation further demonstrates the upward firing of the top mounted swivel drivers aimed upward. The visual representation in the illustration graphically reinforces and confirms the upward directionality of the sound output. Further in the description under the “Activate Multi-Channel Processing” section which is underlined in green, further described is that that the audio signal for the height channel is positioned above under the illustration of the speaker with red arrows disclosing the top-mounted swivel driver is aimed upward for the height channel. This detail explicitly links the upward-firing capability of the swivel 2 ½” “driver” to the "height channel," which is positioned "above" in the audio signal. The prior art Tower Crossover Schematic on page 25 in this Exhibit C. which is further detailed in Exhibit C on page 24discloses a speaker system with a top 2 ½” speaker driver. However, the crossover schematic does not explicitly state that this driver is “up-firing" and "aimed/angled upward." The page from Heather’s Acoustic Labs brochure shown on page 28 clearly discloses the top 2 ½” swivel speaker “driver” is "up-firing" and "aimed/angled upward", “positioned above” for the height channel within the context of the speaker system. While the “Tower crossover Schematic” on page 25 doesn't explicitly disclose the upward angle, the combination of the Tower crossover Schematic on page 25 further detailed on page 24 relevant to opposing claim 1 and, the Acoustic Labs brochure on page 28 which teaches the benefits and implementation of an up-firing and angled speaker driver, would make the claimed combination obvious to a person of ordinary skill in the art at the time the opposing patent application was filed.
